This column parks the hospital file. Two operations are documented. Chart screens omit them on one list and print them on others. He writes about hours of hip vibration and a surgeon whose portal banner says out of office until 29 January 2027. Staff, quoting McGarvey and Karches, say those doctors have not seen him — and the same portal still prints their names on later blood. His claim of an unauthorized smart implant remains unproven as to the physical hardware. Staff denials stay in the file. 9535 / Codex stills live here, not on the homepage. Read the medical door first, in records-first order.
Parked column · not erased
The File — surgeries, portal stills, chart conflicts, staff letters — is the body of this page. The sequence that produced the question — MyScripps, the desk recordings, the no-shows, and the films — is now on Why a smart hip implant. This column is the parked hospital file.
Right THA 9 Oct 2015. Left THA 23 Oct 2017. Both Scripps Green, Richard Walker MD. A converted 2015 packet — generated 23 April, after the 24 February UPLOAD ask — sits as one cover. A visit list on this page still omits both operations.
What they wrote
Walker 17–19 Jun 2025: standard Stryker, no embedded chips. Greene, 26 Jun: no electronic components or bio-chips; Walker will not see further messages. Risk Management 27 May 2025 restates his Bluetooth concern and withholds the review under 1157. The signed letter is on the medical door. The Notice of Privacy Practices and Patient Rights forms on this column are also their paper. A published policy is not a verdict they broke it, and it is not a verdict of innocence.
Why the file stays open
Thin 26 Apr 2017 note. Visit list omits the arthroplasties. A Notes implant row still prints the 2017 left shell 542-11-54F. Surgical history and a 2015 conversion packet print the dates. Staff: 2015 material not in the current EMR because Scripps was not using it then. Walker banner: out of office until 1/29/2027. Karches: not seen since 8/2017, does not know Sheean, another provider after her — a 26 Aug 2019 T4 still prints her name. McGarvey: not seen in five years — 3 Jan 2023 venous blood still prints hers. 677 vs 675. Sheean and Karches on one results page, different days. A Blue Shield visits summary independently lists both THAs as Walker inpatient at Scripps Green, a 09/06/2016 Scripps Clinic Med Labs row, and Quest Diagnostics 22 May 2023.
The theory, labeled
Implants as telemetry. A closed loop into a family ELISA catalog. That is his theory, labeled as such. Device stills are not on this page. His narrative is in The account.

What this file already holds
Portal screens, the MyScripps thread, the 2027 out-of-office banner, and the lab rows next to the doctors’ sentences. Imaging Healthcare pelvis and lumbar reports from 27 August 2015, and the 21 April 2017 note quoting extensive left AVN. The 2015 operative packet as one cover — generated 23 April, after the 24 February UPLOAD ask. The 2025 desk drop, two no-show letters, and the 2024 Irvine films next to the two stills Scripps later attached. Graphic medical images stay on this column. The medical door asks the question. Meter recordings live on Why a smart hip implant. A failed portal payment sits with Phone anomalies. Tray stickers and a 2017 operative packet were not in the mailing they sent. The converted 2015 packet generated 23 April is what arrived.
Closed · stickers
The 23 April packet is what they sent
Implant tray stickers and a 2017 left-hip operative packet were not in that mailing. What they generated on 23 April 2025 — one cover, click for the twelve-page converted 2015 report — sits on Surgeries. A devices page in the February health summary prints the 2017 left Stryker / Biolox / Trident rows. That page is still not stickers from a tray.
Letters
Risk, Walker, Greene — and the desk
Risk Management’s 27 May 2025 close-out is now a hosted face — Maritza Santamaria, Evidence Code 1157, Bluetooth and vibration restated as his concerns. The June–August 2025 MyScripps thread — Greene’s no-biochips line; Walker will not see further messages; a lab slot instead of a surgeon visit; two films in a 13 August bubble; a warning that continued MyChart use may deactivate the portal — and the later MyScripps disable dialog sit in event order on Why a smart hip implant. The 27 May close-out predates that thread. The handwritten drop for Walker, the Pastore and Rosen no-show letters, and Greene’s two-film attachment remain on Walker drop, No-shows, and 2024 / 2025 films.
Messages · left to right
He asked for originals. They typed a parts list.
26 January 2025: DVT imaging — not the 2015 surgery file. 21 February: he writes Dr. Walker for the August 2015 Imaging Healthcare Specialists report that, in his telling, showed the left hip then unaffected. That report is now on this column: 27 August 2015 pelvis MRI, Eric Chou MD — right femoral AVN, no signal abnormality noted in the left hip. 21 February, 7:35 PM: a system message that a health-summary package failed to Hooman.asbaghi@mmimedical.com. 24 February: Walker has retired. Covering doctor: the report is not in the Scripps clinic system; Walker uploaded images; call Imaging Healthcare Specialists at 858.658.6500. That is the number on the letterhead. He attaches four report stills and asks for the devices in the right hip. Staff type a left-hip Stryker Trident PSL HA cup for 10/23/17. At 12:07 PM he writes: he is referring to the October 2015 surgery on his RIGHT HIP; why is there no reference of that surgery; please UPLOAD that info. Staff, 1:33 PM: My apologies; here is the implant info for the 10/09/2015 right THA. That is a typed apology. It is not the operative report.
Megan M. Kuettel, RN, Office of Dr. Kace Ezzet, typed the right-hip Stryker list after he asked why there was no reference to October 2015. The covering doctor wrote that the report is not in the Scripps clinic system. On 12 August Tanya Greene attached a file titled 2015 Op Note and Xray note and wrote that there are no biochips. The twelve-page packet is on Surgeries. Why a Smart Hip points here. It does not host these faces again.
25 March, to Tanya: every component, including part number, of the 2015 right hip. March 26: Medical Records, 760-633-7746, Recordsrequest@scrippshealth.org. The packet they generated in April — one cover, click for the PDF — is on Surgeries. April 21: he writes Dr. Hong that Walker has retired; although he did take questions, there was no response; the question has been removed; the hips vibrate 30–40 hours then start again; there is no record of parts. April 24: a referral to Dr. Craig Swenson. April 30: Dear Scripps — vibrations since 2017, just after the second replacement; he asked if the right hip could have been replaced with a SMART HIP. The rest of that sentence is cut on the still. The banner on that conversation: Richard Walker, MD, out of office until 1/29/2027. A later message types a four-line IMPLANTS list and says to request records from either surgery. Still a message, not stickers. 1 May, his words: he believes the right hip was fitted with an investigational smart hip without his knowledge or authority. Staff point him to Patient Advocate. 1 May, 9:53 AM, a longer sentence: a SMART HIP that could transmit health information, especially genetic information; Walker won’t be back until January of 2027. Portal support: contact Walker’s office or the orthopedic department. The ninety-page health summary generated 21 February is hosted on this column. One echo page in that packet prints in red: This result has an attachment that is not available. That sentence is an echo page. It is not hip-film deletion unless another mounted face says so.
His account
His portal paragraph · already on these strips
He asked what had failed in the hips. He writes that the first-surgery files came back, then were gone.
He wrote that he had asked Walker, on numerous occasions, to help determine the cause of his sudden hip failures, and that he never received a response. About a year ago, reviewing the chart, he noticed the first-replacement files were missing — no notes, no MRI, no X-ray. He reached Walker’s office, was told Walker had retired, and was told the files had not been uploaded because Walker was not in a habit of doing so until later. He asked the nurse to upload them. She did. Then, as he wrote it:
“Unfortunately, was I was reviewing them the following day, they were removed again before I had a chance to form my questions. The issue I’ve been having are intense vibrations which last anywhere from 24 and sometimes close to 60 hours. The vibrations stop but only for a day or two before they start back up. Can you please help”
The following-day sentence is his. The clocks on these faces are not a same-screen before-and-after. A nurse uploading files, and him writing that they were gone the next day, is not a reconstructed takedown. The 24-to-60-hour description sits next to the 30–40-hour line he wrote Dr. Hong. Staff typed lists and pointed him to Medical Records. The published rights form sits next to these messages. A published policy is not a verdict they broke it. The unanswered asks, the visit-list gap, and the doctors who write they have not seen him while later blood still prints their names are why a person would look at the public literature on instrumented implants. That landing is What published science says.
As he goes through the chart he texts, on WhatsApp, what he is seeing. Those are his messages. “I have not been to Scripps clinic since 2017. I only went once in 2019 to see Dr M Garvey and had a video all in 2020.” That sentence is his. He later reads it as no voluntary lab work after 2017, one 2019 checkup, a 2020 video. A CANARY face he quotes as 5/16/2017, and denies, sits next to a hosted form that prints 5/18/2017 — both clocks stay on Consents.

Letter drop · orthopedic desk · 2 Dec 2025
The desk did not know how to find Richard Walker.
A carrier arrived at the orthopedic / joint-replacement desk with a handwritten letter addressed to Richard Walker at Scripps Green. Three recordings from that desk are hosted here. The picture is the floor and the counter. The exhibit is the sound. Staff do not locate an office for that name on the floor. On the longest recording, a staff member says he does not have an office here, but a secretary might take the delivery, and offers to reach her. Asked if he is a patient, the carrier says no — he is dropping something off from a patient. A sticky from the drop names Mary Ancona, Executive Asst., and Roxanna, Front Desk chk-in Ortho.
He writes that the letter never reached Walker. That sentence is his. The public physician page still prints Richard Walker, MD, Orthopedic Surgery, Scripps Clinic Torrey Pines, Sees existing patients only. The portal still prints Out of office until 1/29/2027. Those three records sit on the same file. The same recordings are on the medical door at Why a smart hip implant.
DocumentedHis account
No-shows · Pastore 12 May · Rosen 8 Jul
He did not keep the Torrey Pines appointments.
Two letters, two doctors, two dates. 16 June 2025: concern regarding a no-show or late cancellation on 12 May 2025 with Dr. Pastore at Scripps Clinic Torrey Pines Orthopedic Surgery, 10710 N Torrey Pines Road. 8 July 2025: a no-show that same day with Dr. Rosen at Scripps Clinic Torrey Pines, printed as the 2nd instance within twelve months. Clock 15:17 on the second recording.
He writes that, after persistent concerns, Walker called and invited him in to be checked. He feared that a visit could be used to disable a device and discredit him, and he chose other medical opinions instead. The invitation is his account; no recording of that call is on this file. The disable-fear is his stated reason for the no-shows, not a finding that anyone would disable anything. Street and plan identifiers print on the letters; they are not quoted here.
Portal · what the chart showed him
One list omits the hips. Other screens print them.
After the caption was filed and the vibration at the hips became unignorable, he opened MyScripps looking for the implants. He had already captured a Notes implant row: left shell 542-11-54F, implanted 23 October 2017, Walker, Scripps Green, lot 8938K3. The filename on disk said 2015. The face is 2017. The visit list on this still ends 11 May 2017, Walker, and says there are no more visits to show. Neither arthroplasty is on that list. The 24 February UPLOAD ask for the 2015 right hip is on Messages. Staff type a parts list and write that 2015 material is not in the current EMR because Scripps was not using it then. A registry row he already had is not a visit-list event. Surgical history on another still prints Replacement of thigh bone and hip joint prosthesis, 10/23/2017. A converted 9 Oct 2015 encounter prints imaging guidance in the OR and points to an operative report of the same date. The 26 Apr 2017 progress note is blank except “RV for reports, to be arranged.” A billing screen refused a payment for originals. Read the faces together. The clocks on these screens are not a same-screen before-and-after. A portal view is not a backend.

Surgeries · 24 February UPLOAD · generated 23 April 2025
Converted historical result. Generated 23 April.
The paper that could show what was charted at the 9 October 2015 right hip is not missing from this file anymore. What arrived is a twelve-page Scripps export. The surgery ask is already on Messages: 24 February, 12:07 PM — please UPLOAD the October 2015 right hip. The 26 January still on that thread is DVT imaging, not this packet. Medical Records 26 March. The authorization scan is 22 April. Every page of the PDF prints Generated by 189465 at 4/23/25 8:28 AM. Those are the dates. A report produced after that wait is not the same object, for this investigation, as a report produced when he asked. He does not take it at face value. That reading is his. It is not a finding the pages are forged.
The line to read on the face is the hospital’s own, in orange: “ATTENTION: This is a converted historical result. Dates and procedure details should be carefully reviewed.” Interface conversion signers and 2017 chrome on a 2015 note sit behind that banner. Conventional Stryker / Biolox parts are what they printed. Click the cover for the PDF. The delay and that banner are why this file is on the column. The parts list is not.
The folder was labeled fabricated. The faces print dates.
Nine files arrived in a Drive folder titled Fabricated Docs. That is a folder title. It is not a finding these papers are forgeries. Two are repeats of the Iran Past Visit Details already on Why a smart hip implant— DEXA from Iran, and “Patient signed testosterone contract in past.” Those stay there. A phone still of the same DEXA also printed a number; that number stays off this page. An HTML conversion of the 2025 non-covered form is not hosted. The JPEG of that form is.
AFS IP next to AFS OP on the My Documents list is the hospital’s inpatient/outpatient document pair, Advance Financial Services style — not an internet address. 90630 and 90636 on the 23 October 2017 transfusion consent are 9:06:30 AM and 9:06:36 AM. They are not a Cypress zip code. Those nine files did not print a dotted-quad. A later summary table does.
What the portal list prints: three Consent Form rows added 10/24/2017 — the morning after left THA. AFS IP signed 10/13/2017. AFS IP and AFS OP signed 8/24/2017. Consent Form added 5/19/2017. A faint top row: Signed on 10/14/2020. That is a document date, not a clinic visit. Sit it next to the 21 November 2025 letter that writes he has not been seen at Scripps Clinic since October 14, 2020, without turning either date into the other. The complementary list: NPP Acknowledgement of Receipt signed 5/11/2017; AFS IP and AFS OP signed 5/18/2017.
The CANARY form, 100-8560-035SW (Rev. 6/13/13): patient 5/18/2017 10:38:13 AM; witness 5/18/2017 10:37:59 AM — fourteen seconds earlier. He forwarded that form on WhatsApp at 2:38 PM: “That’s not my signature and I have no idea who that witness is.” That sentence is his. It is already on Messagesas a six-phone strip next to a 5/16 overlay; the still at the top of this section puts the same words on the 5/18 clocks. Sit both. A fourteen-second witness-before-patient stamp is a printed clock. It is not a finding of forgery. His denial is his.
23 October 2017, consent to surgery, page 2 of 2: Dr. Richard Walker, total Hip Replacement, Left Hip. Printed name Hooman Asbaghi. Witness Jean Schindler RN. Same morning, Blood Product Transfusion Patient Consent, same witness, clocks 9:06:30 AM and 9:06:36 AM. Identifiers on the patient sticker print on those faces. 2025 Notice of Non-Covered Service: Date of Service 3/12/2025 as this JPEG prints it. Signature Hooman A Asbaghi, dated 5/10/2025.
A table titled Digital Signature & IP Audit Report names Scripps Health and Notice of Non-Covered Service. Date signed 05/10/2025. Scheduled date of service 05/12/2025. IP address (captured at signing) 66.218.61.129. Geo-IP location (approx.) Rancho Santa Fe / San Diego County, CA. ISP provider, device, timestamp, and cryptographic hash are blank. The footer says the table summarizes visible details and that additional metadata should be obtained from the originating electronic-signature platform. Sit 05/12/2025 next to the JPEG’s 3/12/2025. The table is a summary. It is not proven Scripps e-sign chrome.
Public lookups of that dotted-quad print a Race Tech address. IPinfo names hostname 66-218-61-129.race.com, ASN AS30041, city Rancho Santa Fe, postal 92067, coordinates 33.0203 N, 117.2028 W. The map on that page is North County at city grain — Encinitas, Solana Beach, Del Mar, Rancho Santa Fe, Poway on one pane. ip-api prints 33.0024 N, 117.2128 W for the same IP, more than a mile from IPinfo’s point. That is a database city, not a house. That is the map that belongs here: the lookup’s pin for the IP, not a pin on a house.
21 March 2025, 7:36 PM, his WhatsApp: “Served. That’s my sister’s place.” A house photograph sits under that bubble. The number on the facade is covered. Sit his sentence next to IPinfo’s city map. His identification is his. It is not a finding the signature was captured at that house, and it is not a finding she signed.

Imaging · 27 Aug 2015 / 21 Apr 2017
The left hip was printed clean. Nineteen months later the note prints extensive AVN.
Three documents. Read them as they print. On 27 August 2015, Imaging Healthcare Specialists, Eric Chou MD, dictated an MR pelvis without contrast. Indication: severe right groin and hip pain. Right femoral head: serpentine signal consistent with avascular necrosis. Left hip: no signal abnormality. Phone on the letterhead: 858.658.6500. A companion lumbar MRI the same afternoon is a spine study — mild spondylosis, no stenosis. A lumbar “bones” line is not a sentence about a femoral head.
Right THA follows on 9 October 2015. On a later Past Visit Details screen, he is followed for that replacement. New complaint of left hip pain. MR scan of 4/21/17, as quoted: extensive avascular necrosis of the left femoral head, probable reactive edema in the neck and acetabulum. Left THA 23 October 2017. The problem list starts osteonecrosis that day. He later says the second hip went out in about seven months, against a usual 3–5 years. That interval is his. The papers print 27 August 2015 and 21 April 2017.
In 2025 he asked the portal for that August 2015 report because, in his telling, it was no longer on the chart he could see. Staff wrote that the radiologist report is not in the Scripps clinic system and named Imaging Healthcare Specialists. These stills are that letterhead. A covering-doctor sentence does not prove the archive was erased. The messages.
On 4 February 2026 he wrote to Hadaya: “Despite having had both hips replaced, there’s only one x-ray of the right Hip.” That sentence is his. The calendar date is not on this crop.

Films · 13 Feb 2024 Irvine · then two Scripps stills
One Orange County visit. Ten views. After two replacements, Scripps sent two films.
Click the cover. All ten stills from Dr. Steven Barnett’s 13 February 2024 session at OSI Irvine open in one window. Overlay: Asbaghi Hooman, Pt ID 284505, birth 1/4/1966, PELVIS, exam date 2/13/2024, strat.com. Two screws are visible on one acetabular cup — on the AP and in profile on the laterals. An R marker prints on one AP; the screws sit on the cup opposite that marker. One still is a phone photograph of a monitor titled Hooman 3D Printe…. His WhatsApp: one visit gave him all this.
Below is what Tanya Greene, RN, Clinical Operations Supervisor, Division of Orthopedic Surgery, attached in the portal. Two images. Clock 11:58. Top: Portable X-Table, ASBAGHI HOOMAN-A, R PAD, a toothed / grit-blasted stem. Bottom: both hips on one film; one stem toothed along the edge, the other smoother. The two protruding screws visible on the 2024 Irvine cup are not seen as screws on these two stills. His reading: the right hip is a different material than the left; an entirely different hip. That reading is his. These are different dates and techniques — a 2024 office series versus an undated portable pair. Count, site, and date are documented. The faces do not prove a swapped implant. Written surgery notes he was sent around August 2025 named no embedded devices. Notes are not these films.
Scale of the published electronics sits on What published science says. Housing inside the metal is why a person would not expect a radio to announce itself on a parts list. These cups are not proven to contain one. The 2012 JAAOS review on that door prints a labeled tibial radiograph, so the published class is not invisible on x-ray.

Graphic · his photographs
He photographed his feet. Fluid is on the problem list.
Three close stills and a two-panel contrast, taken over a period of months in his telling. One clock prints Thursday 20 February. One still shows an ankle scar. The two-panel sits on the June–August portal thread because that is when he was writing of RSD-level pain in the left leg. The Health Issues crop already prints accumulation of fluid, 01/30/2025. He asked whether inflammatory papers could explain the swelling. A photograph is not a finding the implant caused edema. Graphic medical images stay on this column.
Labs · authorizing provider is not a visit
They write they have not seen him. The portal still prints their names.
Staff, quoting McGarvey: she has not seen him in five years. He would need to establish as a new patient. The same portal prints Megan McGarvey, MD, as authorizing provider on a comprehensive metabolic panel collected 3 January 2023 at 10:23 AM, venous blood, resulted at Scripps Lab, 9535 Waples St., 150. A results list prints TSH and PSA (Surveillance) 16 January 2023, same name, under a banner Result is from another organization. Karches, as Kelli Karches, MD FACE: she has not seen him since August 2017; no testosterone-suppression medications were on his list then; she does not know a Dr. Sheean; she sees he saw another endocrine provider after her — “Maybe that provider has more details for you regarding your questions.” A T4 Free collected 26 August 2019, 2:34 PM, venous blood, Scripps Lab 9535, prints her as authorizing provider. A results page lists Geoffrey Sheean MD on vitamin B12 collected 13 October 2016, 2:20 PM, and Karches on SHBG collected 30 September 2016, 10:28 AM. Same page. Not the same day. Same lab street. PTH intact 43.9 and calcium 9.6 share the 30 September 2016 collection; authorizing provider on that block is cropped off this still. Authorizing provider is not a clinic visit. Keep every face. A later thread, 29–30 September: he asks how 2023 labs ran under McGarvey’s direction. Staff: yes, she did run tests in January 2023 for the thyroid. He writes he was living in Colombia that month, Cartagena with his wife — that sentence is his. Do not write remote collection. Footer: Megan McGarvey, MD, out of office until 1/5/2026. Same class of banner as Walker until 1/29/2027. The hosted recording scrolls to that line. Their 21 November 2025 letter restates the window as 14 October 2020, on their letterhead — sit that admission next to this blood.
Same chart · Iran named · no performing lab
The note says patient states. Result Trends prints 675.
Past Visit Details names labs drawn in Iran and a DEXA from Iran. Testosterone 1.89 ng/mL is sourced as “patient states it was am.” Vitamin D in Iran 11/2016. A 24-hour urine done in Iran. Repeat DEXA 7/2016 in the US. No performing laboratory is printed. His sentence is that he never consented to share mother’s-lab work with this hospital and never discussed Iran with these doctors. Keep both sentences. The hosted faces — Iran notes, Result Trends 675, Test Details 677, the assay footer, and in-range homocysteine with Sheean — sit on Why a smart hip implant, in the middle of that door, before the disable. They are not copied here a second time.
The insurer list — a second source
Blue Shield of California visits summary, member name as printed, Platinum 90 PPO. Click the covers. The hosted PDFs are the originals. The MyScripps visit list on this column still omits both arthroplasties. This payer list prints 10/09/2015–10/12/2015 and 10/23/2017–10/26/2017 as Richard Walker, SCRIPPS GREEN HOSPITAL, INPATIENT. It prints 09/06/2016 Edward Sakas, SCRIPPS CLINIC MED LABS, OUTPATIENT — the morning the portal clocks 8:16 AM and the docket clocks 9:00 AM. It prints 05/22/2023 QUEST DIAGNOSTICS OUTPATIENT, with Kaveh Karandish the same day, and a Quest results summary the next day under Mojgan Pedram. January 2023 lab rows on this list name the laboratory facilities, not McGarvey; the portal still prints her as authorizing provider on those dates. 10/14/2020 McGarvey VIRTUAL and 08/28/2019 McGarvey OUTPATIENT sit next to his sentence that he saw her once in 2019 and had a video in 2020, and next to staff writing she has not seen him in five years. 10/03/2016 Geoffrey Sheean OUTPATIENT sits next to Karches writing she does not know a Dr. Sheean. 08/24/2017 is her last row on this list. Quote the insurer. Do not write remote collection. Passports on this file are for 2023 lab work and travel after 2020; they are not mounted here yet.
After the disable · their letterhead
21 November 2025. They write not seen since 14 October 2020. January 2023 blood still prints McGarvey.
Scripps Medical Foundation Performance Improvement, mailed by US Postal Service. Records show you have not been seen at Scripps Clinic since October 14, 2020. That is their sentence, on their letterhead. Sit it in the same row as the 3 January 2023 venous comprehensive metabolic panel at Scripps Lab, 9535 Waples, still printing Megan McGarvey as authorizing provider. Staff later confirm she ran tests in January 2023 for the thyroid. Authorizing provider is not a clinic visit. He writes he was in Colombia that month, Cartagena with his wife — that sentence is his. Passport stamps for that travel are not this shelf. Do not write remote collection. They also list messages to Pastore about testosterone, messages to Karches and McGarvey accusing them of “harvesting your DNA,” and continued messages to Walker, “who has been retired for 2 years.” Despite being retired, they write, Dr. Walker did call you back 6/19/25. Street and unit are covered. Quoting his DNA sentence is not a finding DNA was harvested. This letter is after the August disable. It is not the disable.
On 3 December 2025 Scripps Clinic Medical Group wrote that it would not establish or re-establish care with any of its member professionals. Emergency care at Scripps Hospitals stays open. The letter says the decision is not meant to deter him from pursuing any legal rights.

Two Scripps Health forms, next to the chart and the messages already on this column. A published policy is not a verdict that they broke it. A chart problem is not a HIPAA finding by itself.
Notify of unauthorized access
Notice of Privacy Practices: “We will notify you in the event we become aware of an unauthorized access, use or disclosure of your unsecured protected health information.” Staff, quoting McGarvey and Karches, write those doctors have not seen him. Later venous blood still prints their names. That is a chart conflict already on this column. It is not a finding of unauthorized access, and it is not a finding that a breach-notice duty was triggered.
Inspect, copy, amend
Inspect and request a copy — in writing, a reasonable fee, limited denials. Request an amendment if you feel the information is incorrect or incomplete — in writing, with a reason; they may deny; if accepted they are not required to delete. The visit list omits both THAs. A Notes row for the 2017 left shell existed. A health-summary package failed to deliver. A billing screen refused a payment for originals. Staff typed parts lists. He asked them to upload missing 2015 surgery files. He later writes that a nurse did upload first-surgery files and that they were gone the following day, before he could form his questions. That following-day sentence is his. The clocks are not a same-screen before-and-after. Those faces exist. No mounted formal amendment decision is on this file.
All Scripps entities. Reasonable responses.
The notice “applies to all of the records of your care generated by any of the Scripps Health entities, whether made by health care personnel or your physician.” Sit that next to one list that omits the arthroplasties and other screens that print them. Patient Rights item 8: “Reasonable responses to any reasonable requests made for service.” He writes about hours of vibration. A banner prints Walker out of office until 1/29/2027. Staff type lists and point him to Medical Records and Patient Advocate. Print both.
Human experimentation — their sentence
Item 7: “Be told about any human experimentation that the facility or your personal physician proposes to engage in that might affect your care or treatment. You have the right to refuse to participate in such research projects.” That is their sentence. His later claim is an investigational smart hip without knowledge or authority. Hardware remains unproven. Item 7 is why a reader would look. It is not a finding they ran an experiment. The NPP’s research paragraph requires written authorization and an IRB when a study involves treatment. That is bibliography, not a finding research occurred.
6 Sep 2016 · 8:16 AM / 9:00 AM
The portal prints 8:16 AM. The docket prints a 9:00 AM jury trial.
On 6 September 2016 the San Diego Superior Court docket prints a civil jury trial heard at 9:00 AM in Department 74, a verdict filed that day, and judgment rendered that day. That is the morning of Asbaghi / HBA Medical Group v. Nydegger, 37-2013-00066639-CU-PN-CTL. The same morning, MyScripps Test Details prints a testosterone / SHBG panel collected at 8:16 AM, under a catalog title for adult females, children, or any individuals on testosterone-suppressing hormone therapy. SHBG 36. He says he was in that courtroom and did not attend a draw. A listing of the $61,587,000 award prints Result Date Sep. 6, 2016 and Published Oct. 29, 2016. A later Jury Verdict Alert page prints Date of Verdict or Judgment: Thursday, October 20, 2016. October is when those pages went up. The minute order controls the morning. The panel title is a commercial catalog string — the same title prints on 4 August 2017. Forty-four minutes between 8:16 and 9:00 is not proof of a remote draw. The same-morning stack that made him ask the medical question is stated on Why a smart hip implant. A Blue Shield visits summary independently lists 09/06/2016 Edward Sakas, SCRIPPS CLINIC MED LABS, OUTPATIENT — a second source for a laboratory-coded event that morning. Passports on this file are for 2023 lab work and travel after 2020. They are not this morning’s alibi. The docket is.

Pelvis MRI: right AVN. Left hip printed with no signal abnormality.
Imaging Healthcare Specialists, Eric Chou MD. Six weeks before the right replacement. Same 858.658.6500 later named when staff said the radiologist report was not in the clinic system. A same-day lumbar MRI is a spine study.
Documented
Right THA, Scripps Green
Walker attending. Converted operative report lists conventional Stryker / Biolox. Intra-op cup navigation. No electronics on that list.
Conflict — keep both
8:16 AM on the portal. 9:00 AM on the docket.
Test Details: collected Sep 06, 2016 8:16 AM, SHBG 36, catalog title names testosterone-suppressing hormone therapy. Trellis: Civil Jury Trial heard 09/06/2016 09:00 AM; verdict filed that day. A listing of the $61,587,000 award prints Result Date Sep. 6, 2016 and Published Oct. 29, 2016. October is publication. He says he was in court. That is not a remote-draw finding.

Scripps publishes the privacy notice and the patient-rights form on this file
NPP: notify of unauthorized access; inspect and copy; request an amendment; all Scripps entities. Rights: informed consent; be told about human experimentation; reasonable responses; grievance in 10 days. Sit those sentences next to the chart and the messages. A published policy is not a verdict they broke it.

MTHFR + Sheean-authorized labs
Test Details prints 677C>T. Result Trends prints c.675C>T. Assay footer names 677. Karches later writes she does not know Sheean.
Conflict — keep both
Left hip: extensive AVN on the 4/21/17 MR, as the note quotes it
New complaint of left hip pain. 27 Aug 2015 pelvis MRI had printed no signal abnormality on the left. He later says about seven months. The papers print August 2015 and April 2017.
Documented
Left THA, same hospital, same surgeon
Implant card and consent faces. Problem-list osteonecrosis date vs April MRI is a conflict.
His account
He says he mentioned vibration to Walker
The article quotes “loose parts.” That sentence is his account until a note prints it.
His account
He reports 30–40 hour vibration episodes
His account of hours of vibration. Meter recordings from when he later measured sit on Why a smart hip implant. Not a device identity.
His account
He measured when the sensation was on, and when it was not
GQ EMF-390 and a second K18. High near him when he says the vibration was on; Normal on the same kitchen counter when he says it was off; Normal at the walls. Units are V/m, not volts. Consumer meters false-alarm. His inference that the origin is inside him is his. Then he opened the portal.
Conflict — keep both
He opens the chart. A Notes implant row existed. The visit list omits the hips.
He had already captured a Notes row for the 2017 left shell 542-11-54F. Visit list ends 11 May 2017. Surgical history and a 2015 conversion packet still print the operations. He writes that the 2015 surgery is not referenced. Staff type a parts list and write that 2015 material is not in the current EMR because Scripps was not using it then. Covering doctor: the August 2015 radiologist report is not in the clinic system. He writes: I’m referring to the October 2015 surgery on my RIGHT HIP. Staff: My apologies, here is the 10/09/2015 implant info. That apology is not stickers. The clocks are not a same-screen before-and-after.
His account
The theory crystallizes
Unrecognized Bluetooth on the phone, in his telling. Scanner stills and GATT tables stay off this page as methods.

Walker’s banner says 1/29/2027. He is describing hours of vibration.
Out of office until 29 January 2027. He writes Dr. Hong that although Walker did take questions, there was no response, and that a question was removed. A portal paragraph on the same communications stills asks Walker about sudden hip failures; writes that first-surgery files were missing, uploaded by a nurse, and gone the following day; and describes vibrations lasting 24 and sometimes close to 60 hours. Can you please help. Quote him. The following-day sentence is his. The clocks are not a same-screen before-and-after. Dear Scripps: he asked if the right hip could have been replaced with a SMART HIP. Cut on the still. This is still a question, not the 1 May claim.
His account
His portal sentence: investigational smart hip, without knowledge or authority
Printed as he wrote it. Staff point him to Patient Advocate. The claim stays labeled. Hardware is unproven.

Greene: no bio-chips; Walker will not see further messages
As discussed with Dr. Walker, she writes. Directs him to Rosen. Typo as printed. Not an acquittal.
Documented
Walker: standard Stryker, no embedded chips
Their words, on paper. Portal also prints retired / out until 29 Jan 2027. Both stay.
Conflict — keep both
Doctors write they have not seen him. The portal still prints their names on later blood.
Karches: not seen since 8/2017; does not know Sheean. A 26 Aug 2019 T4 Free prints her as authorizing provider. McGarvey, via staff: not seen in five years. A 3 Jan 2023 venous CMP prints hers. Authorizing provider is not a visit. Same-page Sheean and Karches are different days.
Context
Three names · keep them apart
Scripps Research is not Scripps Health, and not Scripps Green
They were one enterprise. Scripps Research’s own history page prints that in 1991 the Scripps Clinic and Research Foundation and Scripps Memorial Hospital reaffiliated, with the former — by then named The Scripps Research Institute — becoming a legal nonprofit, and that in 1993 the Research Institute separated from Scripps Health to become an independent organization. Origin is real. The 2020 NIH order and the 2018 physical-therapy order are still different defendants. A common founder in 1924 and a 1993 split do not make grant-accounting at Jupiter into the hospital that ran these two operations, and they do not prove the institute shares a chart with Scripps Green.
Institutional settlements in this city are real, and they are not interchangeable. On 11 September 2020 The Scripps Research Institute agreed to pay $10 million to settle False Claims Act allegations that it mischarged NIH-funded grants between 2008 and 2016 for faculty time spent writing new applications, teaching, and other administrative work. Campuses named: Jupiter and La Jolla. That is the independent biomedical institute — not the hospital that ran these two operations. Times of San Diego covered the same order.
None of this is direct evidence tied to this patient’s two arthroplasties. It is why a reporter would not treat every institutional-oversight question in this city as unserious. The surgeries, the portal, and the staff letters remain the file.

The Network
Sister-named fundraising pages, the Torrey Pines research street, and alleged monitoring are a different strength of claim. They are not a finding about the hips. That page stays mounted.
