The Hooman Asbaghi Case

A filing is not a verdict. Nothing on this site is a finding of liability.

What the chart printed

The visit list omitted the operations. On 25–26 January 2025 the portal printed an overnight hospital clock at 9888 Genesee. Iran on the note prints 675 next to 677. The morning the verdict was filed, the portal printed an 8:16 AM collection.

The implant row existed in the app. The visit list does not print the operations.

He opened the chart looking for the hips. MyScripps Notes still prints the 23 October 2017 left shell — 542-11-54F, lot 8938K3, Walker, Scripps Green. Filename on disk said 2015. The face is 2017. The visit list ends 11 May 2017 and says there are no more visits to show. Neither arthroplasty is on that list. Surgical history on another screen prints Replacement of thigh bone and hip joint prosthesis, 10/23/2017. The 26 April 2017 Walker progress note is blank except “RV for reports, to be arranged.” Identifiers on these faces stay as printed.

27 Aug 2015: left hip printed clean. 21 Apr 2017: extensive AVN.

Imaging Healthcare Specialists, Eric Chou MD, MR pelvis: right femoral AVN, no signal abnormality in the left hip. The left hip is the clean line. The right femoral head already prints avascular necrosis, and that side is replaced on 9 October 2015, six weeks later. A Past Visit Details screen then quotes a 4/21/17 left-hip MR: extensive avascular necrosis of the left femoral head. The papers print August 2015 and April 2017, about twenty months. The left replacement is 23 October 2017. He later says that interval was about seven months, against a usual 3–5 years. In 2025 he asked the portal for the August report; staff named the same 858.658.6500 on that letterhead and wrote that the radiologist report was not in the clinic system. The full imaging set stays on the hospital file.

Doctors write they have not seen him. Later blood still prints their names.

Staff, quoting McGarvey: she has not seen him in five years. A 3 January 2023 venous comprehensive metabolic panel at Scripps Lab, 9535 Waples St., 150, still prints her as authorizing provider. A later portal thread, 29–30 September, asks how 2023 labs ran under her direction. Staff: yes, she did run tests in January 2023 for the thyroid. He writes he was in Colombia / Cartagena that month — that sentence is his; do not write remote collection. Footer: Megan McGarvey, MD, out of office until 1/5/2026. Same class of banner as Walker until 1/29/2027. Their 21 November 2025 letter writes he has not been seen at Scripps Clinic since 14 October 2020 — that admission next to the 2023 blood. Karches: not seen since 8/2017. A T4 Free collected 26 August 2019 still prints her name. Authorizing provider is not a clinic visit. Keep every face. The labs.

His account

He says he was not in that hospital that night.

Documented

26 January 2025 was a Sunday. A Patient Health Summary generated 21 February 2025 prints last-filed vitals at 25 January 2025, 11:48 PM, and at 26 January 2025, 2:05 AM. The same file prints venous blood collected 26 January 2025, 12:13 AM PST, received 12:19 AM, authorizing provider Justin Hering, MD. Performing organization on those pages: LA JOLLA LAB · 9888 Genesee Ave · La Jolla, CA 92037 · 858-626-6039.

9888 Genesee Ave is Scripps Memorial Hospital La Jolla. The hospital lists emergency services open 24 hours. The outpatient draw bench next door at 9898 Genesee — Anderson Pavilion Lab — publishes Monday–Friday, 7:00 AM–5:30 PM.

The appointments Past list on the portal recordings prints 25 January 2025 as Emergency Department, Scripps Memorial / Prebys. The 21 February lab pages do not print the words Emergency Department. They print the collection time and the hospital address. On 21 November 2025 Scripps Medical Foundation wrote that records show he has not been seen at Scripps Clinic since 14 October 2020. A Memorial night is not a Clinic visit. Authorizing provider is not a Clinic appointment. Sit the rooms next to each other. A 29 January 2025 echo page prints “This result has an attachment that is not available.” Authorizing provider Eric Hong, MD. That face is already on the hospital file.

Middle of the file · before he accused the portal

The chart names Iran. It does not name a performing lab. Result Trends prints 675, not 677.

This is the paper that sat in the chart before the later accusations and before the disable. Past Visit Details names labs drawn in Iran and a DEXA from Iran. The testosterone from that work is sourced as “patient states it was am”: 1.89 ng/mL against a printed 2.8–8. Vitamin D 51.6 nml in Iran 11/2016. A 24-hour urine collection done in Iran. Repeat DEXA 7/2016 here in the US, lumbar T-score −3.0, left hip −2.4, ordered because “the protocols for DEXA in Iran may not be standardized with DEXA here.” No performing laboratory is named. His sentence is that he never consented to share work from his mother’s laboratory with Scripps, never discussed Iran with these doctors, and did not bring those values in. Sit that next to “patient states.” A missing performing-lab line is not a finding Pathobiology ran the draw. It is why the question exists.

Same file, 13 October 2016, 2:20 PM. Result Trends prints MTHFR Variant: c.675C>T, heterozygous, next to 1298A>C heterozygous. Do not confuse 675 with 677. Test Details for the same collection prints MTHFR Mutation 677C>T, heterozygous, interpretation compound heterozygous 677C>T/1298A>C. The assay footer names MUTATIONS TESTED: 677C>T and 1298A>C, methodology GenMark Dx eSensor XT, limitations C677T and A1298C. Three strings. Keep them. Homocysteine that morning is 10.1 µmol/L, inside the printed 5–15 range. Authorizing provider: Geoffrey Sheean, MD. Resulting lab: CENTRAL LAB. Karches later writes she does not know a Dr. Sheean. The numbers on several of these rows are ordinary. The question he asked was how the work was acquired, not whether every value was flagged high.

Pathobiology Laboratory Center’s public menu names C677T and A1298C. That is assay-name overlap with the footer, already on Pathobiology. It is not a performing-lab line on this chart. The hospital file keeps the same stills at Scripps · Iran on the note. Portal disable comes later on this door.

Conflict — keep both

Same morning · 6 Sep 2016

The portal prints 8:16 AM. The docket prints a 9:00 AM jury trial.

This is why the date sits on this door, not on the biography page. On 6 September 2016 the San Diego Superior Court docket prints Civil Jury Trial heard 09/06/2016 09:00:00 AM, Department 74, and a verdict filed that day. That is the morning of Asbaghi / HBA Medical Group v. Nydegger, 37-2013-00066639-CU-PN-CTL. Result Date is 6 September 2016. Published Oct. 29, 2016 is a later listing. The same morning, MyScripps Test Details prints a testosterone / SHBG panel collected at 8:16 AM, under a catalog title for adult females, children, or any individuals on testosterone-suppressing hormone therapy. The printed catalog title names testosterone-suppressing hormone therapy. A catalog title is not a finding that therapy was given. Karches later wrote she saw no suppression medications on his list. SHBG 36. He says he was in that courtroom and did not attend a draw. The panel title is a commercial catalog string — the same title prints on 4 August 2017. Forty-four minutes between 8:16 and 9:00 is not proof of a remote draw. Hospital crops of the same faces also sit on Scripps. A Blue Shield visits summary independently lists 09/06/2016 Edward Sakas, SCRIPPS CLINIC MED LABS, OUTPATIENT. That is a second source for a laboratory-coded event that morning. Passports on this file are for 2023 lab work and travel after 2020. They are not this morning’s alibi. The docket is.
