The Hooman Asbaghi Case

A filing is not a verdict. Nothing on this site is a finding of liability.

Section 05e

What the hospital answered

On 27 May 2025 Risk Management restated Bluetooth and vibration as his concerns. Devices joined when he said the vibration was on. Greene wrote there are no bio-chips. MyScripps later printed that the account is disabled.

Risk Management closed the review. The outcome is withheld.

Dated 27 May 2025 — before the June portal thread on this door. Maritza Santamaria, Director of Performance Outcomes & Risk Management, Scripps Medical Foundation, writes that the letter responds to concerns regarding care by Scripps Clinic Orthopedic Surgeons since 2015. Specifically, she writes, you feel your hip implant contains Bluetooth signals, causing vibration sensations. Device information was provided. An appointment to discuss with Orthopedics was offered, the letter says, and declined. A confidential quality review was completed. Findings are protected by California Evidence Code 1157. She is unable to share the outcome. She encourages an orthopedic visit. The letter confirms the conclusion of the review.

Restating Bluetooth and vibration as his reported concerns is not an admission that a radio sits in the stem. The letter does not answer the question the file keeps asking: were these implants modified, yes or no. It names no findings, offers no explanation, and closes the review. An orthopedic visit, printed as offered and declined, is not a substitute for that answer. Withholding a peer-review outcome is not a finding that nothing happened, and it is not a finding that something did. The Pastore no-show letter names 12 May; this letter does not name that slot.

On 27 May 2025 Scripps Risk Management restated Bluetooth signals and vibration sensations as his reported concerns. That letter is already on this door. An iPhone named iPhone Big shows [LG] webOS TV Connected on the same Settings list as iPad and iPhone, without an info button. CLI-W210W-01 is a separate name on that door. Those stills already live on Phone anomalies. A 27 April 2025 log headed [LG] webOS lists Heart Rate service 0x180D. 0x180D is a Bluetooth SIG heart-rate service. An LG webOS name advertising that service is the odd face. It is not a finding that a television is the implant.

Greene wrote that Walker will not see further messages. Then she sent two films.

24 June, 2:58 AM: a third-person paste about inflammation and telemetry-linked behavior. Five days earlier, 19 June at 6:17 PM, he had texted that Dr. Walker called, then that he had spoken to the attorney. There is no recording of that Walker call. The text. 6:40 AM, his words: vibrating from the second year after the second implant; whether Walker received an authorization, or whether someone else uploaded SMART HIPS. He names a friend, Dr. Saeed, as the face prints it. 26 June, 3:39 PM, Tanya Greene, RN, Clinical Operations Supervisor, Division of Orthopedic Surgery: “As discussed with Dr. Walker, your implants do not have any electronic components or ‘bio-chips’.” She asks whether Dr. Saeed is an orthopedic surgeon, points him to Rosen, and writes: “Dr. Walker will not see these or any future messages ou are sending.” The typo is as printed. Footer: the conversation is too old to reply. Sit that sentence next to retired, out of office until 1/29/2027, and Sees existing patients only. A staff denial is not an acquittal.

8 July, 2:28 PM — the same calendar day as the Rosen no-show letter. He writes: it is very difficult for him to verbalize this; ever since the issues over his hips started, he is concerned over coming over there. A numbered list follows: vibrations after the second replacement; Walker dismissed them; retired, then a 48-hour banner, then January 2027; a complaint letter that will not share findings. He wants to know what was placed. Those are his words, including items the face prints that remain alleged. 3:19 PM: Dear Tanya, please forgive my no show; I changed it to the 10th last night; the intensity of the vibrations and the pain in the left leg (RSD) have really been out of control; he is in too much pain for now; he wanted Walker. Read that next to the photographs of marked swelling in the feet — graphic stills also sit on the hospital file. He is a patient in marked pain, writing at 2:28 PM that he can barely put it into words, asking what was placed in him, after a complaint letter that would not share findings. That is the record. 10 July, 7:58 AM, Scripps Health Team: the appointment he rescheduled is a lab appointment. No surgeon reschedule is on the chart. Call 858-554-7993. The staff bubble is cut at “one of our.”

12 August, 4:47 AM: he writes they did not provide what he requested, and asks again for a full detailed report including post-surgery imaging of both hips — asking for almost a year. 7:19 PM, Greene: attached the documents requested; refrain from further biochip-related accusations; no biochips involved in your surgery; MyChart is for recent-visit follow-up, medications, results, scheduling — not new or ongoing care concerns. Continued use outside those guidelines may result in deactivation of the MyScripps portal account. Four attachments. Visible chip: 2015 Op Note and Xray note. The clocks on this still are 12–13 August. A 10 August records ask is not printed on this dump.

13 August, 11:17 AM: thanks, and please send the actual post-surgery imaging. 11:19 AM: he will schedule. 11:53 AM, Greene: “Here are the images as requested.” Two films sit in that bubble. That count is the evidence. The opened 2015 op note is an XR PELVIS 1 VIEW conversion, created 8/12/2025. The same two stills are opened on the films chapter. This bubble is why there are two, not a second gallery.

MyScripps printed: Your account is disabled.

Two login dialogs on one still. Right, clock 08:22, MyScripps: “Your account is disabled. Please contact your health provider to reactivate it.” That is the disable finding. Left, clock 09:10, a MyChart Custom Server: “We couldn’t log you in right now. Please try again.” That is a different organization and a different sentence — a temporary failure, not a disable. Usernames print on the face; they are not quoted here. No calendar date prints on either clock. Greene’s 12 August warning was that continued MyChart use outside visit follow-up may result in deactivation. Sit the warning next to this dialog. Sit both next to the 8 July sentences — too much pain, RSD, asking what was placed — and next to the 12 August ask for imaging he had requested for almost a year. After that sequence, the portal printed disabled. A disable screen is not a finding about an implant, and it is not a finding of who entered the disable.

The desk did not know how to find Richard Walker.

A carrier arrived at the orthopedic / joint-replacement desk with a handwritten letter addressed to Richard Walker at Scripps Green. Play the three recordings. The picture is the floor and the counter. The exhibit is the sound. Staff do not locate an office for that name on the floor. On the longest recording, a staff member says he does not have an office here, but a secretary might take the delivery. Asked if he is a patient, the carrier says no — he is dropping something off from a patient. A sticky from the drop names Mary Ancona, Executive Asst., and Roxanna, Front Desk chk-in Ortho.

He writes that the letter never reached Walker. That sentence is his. The public physician page still prints Richard Walker, MD, Sees existing patients only. The portal still prints Out of office until 1/29/2027. Those three records belong on the same door. Who is Richard Walker.

4 · Pastore 12 May · Rosen 8 Jul

He did not keep the Torrey Pines appointments.

Two letters, two doctors, two dates. 16 June 2025: concern regarding a no-show or late cancellation on 12 May 2025 with Dr. Pastore at Scripps Clinic Torrey Pines Orthopedic Surgery. 8 July 2025: a no-show that same day with Dr. Rosen, printed as the 2nd instance within twelve months. Clock 15:17 on the second recording.

He writes that, after persistent concerns, Walker called and invited him in to be checked. He feared that a visit could be used to disable a device and discredit him, and he chose other medical opinions instead. The invitation is his account; no recording of that call is on this file. The disable-fear is his stated reason for the no-shows, not a finding that anyone would disable anything. Street and plan identifiers print on the letters; they are not quoted here. On 8 July at 3:19 PM he wrote Tanya to forgive a no-show and said he had changed the slot to the 10th. Staff replied 10 July: that reschedule is a lab appointment. The July thread.
